Terms of Service

1. Agreement
By using the services provided by Viral Host Digital ("Company," "we," "us," or "our"), including our website design, hosting, and CRM platform services, you ("Client") agree to these Terms of Service. If you are using our services on behalf of a business, you represent that you have authority to bind that business to these terms.
2. Services
Viral Host Digital provides:
- Website design, development, and hosting for small businesses
- The Viral Host CRM platform — a customer relationship management system including pipeline management, contact tracking, email communication, SMS messaging, appointment scheduling, and related tools
- Business visibility and analytics reporting
- White-label CRM licensing for reseller Clients
3. Accounts and Access
Access to the Viral Host CRM portal requires a verified account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use at hello@viralhostdigital.com.
Account access is managed via Amazon Cognito with role-based permissions. We support multi-factor authentication and recommend its use.
4. Payment and Billing
Services are billed on a monthly or annual basis as agreed at sign-up. Payments are processed by Stripe. By providing payment information, you authorize us to charge the applicable fees on the recurring billing date.
We reserve the right to suspend access to the platform for accounts with overdue balances. Prices may change with 30 days' written notice to the Client's email on file.
5. SMS Messaging — Acceptable Use
The CRM platform includes the ability to send and receive SMS messages via Twilio. By using SMS features, you agree to:
- Only send messages to individuals who have provided their phone number and have a reasonable expectation of receiving communications from your business (existing customers, people who submitted a service inquiry, or contacts who have otherwise consented)
- Include opt-out instructions (e.g., "Reply STOP to unsubscribe") in all outbound messages where required by law
- Honor all STOP requests immediately — the platform automatically flags opt-outs
- Comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and all applicable federal, state, and local laws governing commercial SMS communications
- Complete required A2P 10DLC carrier registration before sending messages at scale
- Not use SMS features for spam, unsolicited marketing, or any illegal purpose
We reserve the right to immediately suspend SMS access for any account found to be in violation of these requirements or Twilio's Acceptable Use Policy.
6. Data Ownership
You retain ownership of all data you or your end users submit to the Viral Host CRM platform ("Client Data"). We process Client Data only to provide the services described in these Terms. We do not sell Client Data to third parties.
You grant us a limited, non-exclusive license to store, process, and transmit Client Data as necessary to operate the platform on your behalf.
7. White-Label Reseller Terms
Clients who license the Viral Host CRM for white-label resale to their own customers ("Resellers") agree to:
- Ensure their end customers receive appropriate notice of how their data is handled
- Maintain their own privacy policy and terms of service for their end customers
- Comply with all SMS messaging regulations applicable to their end customers' messaging activity
- Not represent the Viral Host CRM as their own proprietary software in any misleading way
8. Acceptable Use
You agree not to use our services to:
- Violate any applicable law or regulation
- Transmit spam, unsolicited bulk messages, or harassing communications
- Attempt to gain unauthorized access to any system or data
- Scrape, reverse-engineer, or reproduce the platform's software or infrastructure
- Interfere with the availability of the platform for other users
Violations may result in immediate account suspension without refund.
9. Uptime and Service Availability
We use commercially reasonable efforts to maintain platform availability. The platform is built on AWS infrastructure with CloudFront CDN and redundant architecture. We do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance when possible via the portal Updates tab.
10. Limitation of Liability
To the maximum extent permitted by law, Viral Host Digital's total liability for any claim arising from your use of our services shall not exceed the total fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
We are not responsible for third-party service outages (AWS, Twilio, Stripe, Google) that affect platform functionality.
11. Termination
Either party may terminate services with 30 days' written notice. We reserve the right to terminate immediately for material breach of these Terms, including violations of the SMS Acceptable Use policy.
Upon termination, Client Data will be retained for 90 days and then deleted. You may request an export of your data during this period.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email to Clients at least 14 days before taking effect. Continued use of our services after that date constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Disputes shall be resolved in the courts of Texas.
